The Comeback Movement Co. — Terms & Conditions

Welcome to The Comeback Movement Co. These Terms & Conditions govern your use of our website, online services, client portal infrastructure, and your participation in our professional out-of-network physical therapy tracks or our private, borderless athletic performance coaching programs. By accessing this website, scheduling an assessment, or engaging with The Comeback Movement Co., you explicitly agree to be bound by these Terms & Conditions.

1. Services & Program Tracks Provided

The Comeback Movement Co. operates a strict dual-track business model designed to provide distinct pathways based on client goals, health status, and administrative compliance parameters:

  • Physical Therapy Track (Clinical Out-of-Network Care): Provides skilled, performance-focused physical therapy, movement rehabilitation, and orthopedic evaluation designed to support clinical recovery, restore functional capacity, and resolve active physical impairments or musculoskeletal restrictions. This track is restricted strictly to local residents within authorized licensing jurisdictions (State of Oregon).

  • Performance Coaching Track (Private Borderless Fitness Support): Provides non-clinical athletic conditioning, strength development profiling, sports movement mechanics tracking, training volume management consulting, and lifestyle accountability programming. This track operates entirely under our signature three-phase athletic continuum: RESET (The Performance Assessment), REBUILD (The Performance Session), and RETURN (The Performance Membership). These coaching services are borderless, do not constitute medical care, skilled rehabilitation, or physical therapy treatment, and are strictly ineligible for health insurance or Medicare reimbursement.

2. Client Relationship & Expectations

Participation in any program offered by The Comeback Movement Co. does not guarantee specific athletic outcomes or clinical results. Progress varies based on individual physical circumstances, training consistency, baseline health factors, and adherence to professional recommendations. Patients, clients, and athletes are solely responsible for actively participating in their customized plan, accurately communicating physical history and current training volume data, and adhering to appropriate safety parameters during all virtual movement sessions.

3. Scheduling, Communication, and Client Portals

Individuals are expected to attend scheduled strategy sessions, calls, or appointments on time and communicate exclusively through our approved business channels. Practice Better is our primary secure administrative platform for:

  • Self-directed scheduling and appointment booking.

  • Secure client-to-coach portal communication and secure text messaging.

  • Program documentation, training volume logs, and performance video analysis distribution.

  • Financial transaction processing, invoicing, and retail receipt management.

Public social media direct messaging (including Instagram and LinkedIn) and personal contact channels are not monitored for service coordination and must not be used for professional communication.

4. Payment & Financial Policies

Payment is due in full at the time of service or according to the specific billing intervals of your selected program, package, or recurring membership tier. Private-pay pricing, ongoing billing schedules, and specific session parameters will be communicated clearly prior to enrollment or assessment booking.

  • Commercial Out-of-Network Superbills: Qualifying, non-Medicare clinical physical therapy patients inside the State of Oregon may request an itemized medical superbill for clinical sessions to submit independently to private commercial health insurance providers. The practice does not guarantee insurance reimbursement.

  • Private Pay / Medicare Performance Coaching Tracks: All fees for our borderless performance coaching tracks (RESET, REBUILD, and RETURN memberships) are processed strictly as private, out-of-pocket, retail cash-pay transactions. These coaching packages completely exclude all clinical medical infrastructure (including National Provider Identifier credentials, medical taxonomy labels, CPT billing codes, and ICD-10 diagnosis codes). Clients are explicitly prohibited from submitting invoices or receipts from these coaching tracks to Medicare, supplemental insurers, or private commercial carriers for reimbursement.

5. Cancellations & Rescheduling

Individuals are completely responsible for providing appropriate advanced notice when unable to attend scheduled 1-on-1 virtual sessions or strategy calls. A strict 24-hour appointment cancellation protocol is enforced. Sessions canceled, modified, or missed with less than 24 hours of advance digital notice will be billed at the full out-of-pocket rate of the slot.

6. RETURN Membership Scheduling Protection

For clients enrolled in our recurring RETURN I, II, or III Performance Coaching Memberships, all live 1-on-1 virtual strategy calls must be scheduled by the client within the active billing cycle up to their designated tier limit. Unused strategy calls or coaching consultations do not roll over to subsequent months and are not eligible for refunds or credits. Responsibility for initiating, scheduling, and executing available member calls rests entirely on the client through the Practice Better dashboard widget.

7. Website Use & Educational Disclaimer

All descriptions, articles, graphics, resources, and general media provided on this website are intended strictly for educational and general information purposes. Website content does not constitute professional medical advice, clinical diagnosis, or physical therapy treatment, and does not establish a provider-patient relationship. Accessing this site does not replace an individualized, formal evaluation by a licensed healthcare professional.

8. Intellectual Property

All website layouts, brand architecture, logos, custom written descriptions, photographic media, graphics, video content, and digital exercise programming resources provided by or created under The Comeback Movement Co. are protected under applicable intellectual property laws. These custom digital assets remain the exclusive property of the company and may not be copied, reproduced, shared, or distributed without explicit written permission.

9. Limitation of Liability

Participation in physical therapy, structural exercise, progressive weight loading, sports performance testing, and athletic conditioning activities involves inherent physical risks. Individuals acknowledge sole responsibility for communicating accurate health histories, following safety cues, and participating at a safe internal physical capacity. The Comeback Movement Co. LLC, its founders, and its staff are explicitly not liable for any outcomes or injuries resulting from an individual's failure to provide accurate physical data, failure to follow coaching guidance, or separate training participation outside the scope of provided instructions.

10. Changes to Terms & State Jurisdiction

The Comeback Movement Co. reserves the right to update these Terms & Conditions at any time as federal regulations, state laws, technology systems, or corporate compliance needs change. This Agreement is executed, governed, and interpreted under the laws of the State of Oregon, and any legal interpretation or dispute resolution will take place exclusively within the courts located in the State of Oregon.
